Welcome to Gardening Wimbledon. These Terms and Conditions govern your use of our gardening services and outline the responsibilities and expectations between you and our team. By engaging our services, you agree to comply with and be bound by these terms.
1. Services Provided
Gardening Wimbledon offers a comprehensive range of gardening services designed to meet your specific needs. Our services include but are not limited to:
- Garden Design and Planning: Creating customized garden layouts tailored to your preferences.
- Planting and Landscaping: Selection and installation of plants, trees, and shrubs.
- Garden Maintenance: Regular upkeep including mowing, pruning, and weeding.
- Seasonal Services: Preparing gardens for different seasons, such as spring planting and autumn clean-up.
2. Booking and Scheduling
To schedule our services, please provide detailed information about your gardening needs. We will confirm availability and provide an estimated timeline for completion. All bookings are subject to our availability and may require a deposit to secure the appointment.
2.1. Cancellation Policy
If you need to cancel or reschedule a service, please notify us at least 48 hours in advance. Cancellations made within 24 hours of the scheduled service may incur a cancellation fee.
3. Payment Terms
Payments for our services are due upon completion of the work unless otherwise agreed upon in advance. We accept various payment methods, including bank transfers, credit cards, and other electronic payments. All prices are quoted in GBP and are subject to change based on the scope of work required.
3.1. Late Payments
Late payments may result in additional charges and could affect the continuation of our services. We reserve the right to charge interest on overdue invoices at a rate of 2% per month.
4. Client Responsibilities
As a client, you are expected to:
- Provide accurate information regarding your gardening needs and site conditions.
- Ensure access to your property during the scheduled service times.
- Obtain any necessary permits or permissions if required for specific gardening activities.
- Notify us promptly of any changes to the agreed-upon services.
4.1. Site Preparation
Clients may need to prepare the garden area by removing personal items or ensuring pets are secured during service hours. Gardening Wimbledon is not responsible for any damage to personal property left in the garden area.
5. Liability and Insurance
Gardening Wimbledon is fully insured to cover any accidental damage that may occur during the provision of our services. However, we are not liable for indirect or consequential losses, including but not limited to loss of use of your garden or any delays in service.
5.1. Property Damage
While we take utmost care in performing our services, any damage caused by our team will be promptly addressed and rectified at no additional cost to the client, provided it is reported within 24 hours of service completion.
6. Changes to Terms and Conditions
Gardening Wimbledon reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.
6.1. Notification of Changes
Updates to the Terms and Conditions will be communicated via email or through our official communication channels. It is the client's responsibility to stay informed of any changes.
7. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
7.1. Dispute Resolution
In the event of a dispute, both parties agree to seek an amicable resolution through negotiation before pursuing legal action.
8. Confidentiality
Gardening Wimbledon respects your privacy and commits to maintaining the confidentiality of any personal information provided. We will not disclose your information to third parties without your explicit consent, except as required by law.
8.1. Data Protection
All personal data is handled in accordance with the General Data Protection Regulation (GDPR) to ensure your information is secure and used appropriately.
9. Intellectual Property
All designs, plans, and materials created by Gardening Wimbledon remain the intellectual property of the company. Clients are granted a limited license to use these materials for personal purposes, and any commercial use requires prior written consent.
9.1. Usage Rights
Clients may use the provided designs and materials for maintaining their gardens, but may not redistribute or resell them without permission.
10. Termination of Services
Gardening Wimbledon may terminate services at any time if the client violates these Terms and Conditions or engages in behavior that is disruptive or harmful to the team. In such cases, any outstanding payments for services rendered up to the point of termination will still be due.
10.1. Immediate Termination
Services may be terminated immediately if there is evidence of fraud, abuse, or illegal activities related to our services.
11. Force Majeure
Gardening Wimbledon is not liable for any failure to perform its obligations where such failure is as a result of Acts of Nature, government regulations, or other causes beyond our reasonable control.
11.1. Unforeseen Events
In events such as natural disasters, pandemics, or other unforeseen circumstances, we will notify clients promptly and make reasonable efforts to reschedule services.
12. Acceptance of Terms
By engaging Gardening Wimbledon’s services, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions. It is recommended that you review these terms periodically to stay informed of any updates or changes.
